Welcome to CulinAiry! These Terms of Service ("Terms") govern your access to and use of the CulinAiry website, applications, APIs, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By creating an account or otherwise using the Services, you confirm that you are at least 18 years old or the age of majority in your jurisdiction, and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you agree to these Terms on behalf of that organization.

2. Account Registration and Security

You must provide accurate and complete information when creating an account. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. User Content

Our Services allow you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You retain ownership of any intellectual property rights that you hold in that Content. In short, what belongs to you stays yours.

By submitting Content to CulinAiry, you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, and distribute your Content in connection with operating and providing the Services.

4. Acceptable Use

You agree not to engage in any of the following prohibited activities:

  • Using the Services for any illegal purpose or in violation of any local, state, national, or international law.
  • Violating our Fair Usage Policy, including circumventing rate limits or quotas.
  • Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Services.
  • Impersonating another person or otherwise misrepresenting your affiliation with a person or entity.

5. Subscriptions and Payments

Certain aspects of the Services are provided for a fee or other charge ("Premium Services"). If you elect to use paid features, you agree to the pricing and payment terms as we may update them from time to time. All payments are non-refundable except as expressly set forth in these Terms or required by applicable law.

CulinAiry utilizes artificial intelligence to generate recipes, meal plans, nutritional estimates, and coaching advice. This information is provided for educational and entertainment purposes only and should not be construed as medical, nutritional, or health advice. Always consult with a qualified healthcare provider before making significant changes to your diet or if you have specific health conditions or allergies. CulinAiry does not guarantee the accuracy, safety, or palatability of AI-generated recipes.

7. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will immediately cease.

8. Limitation of Liability

In no event shall CulinAiry, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; or (iii) unauthorized access, use or alteration of your transmissions or content.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms.
